House of the Wind – Bonaire
1. General
These General Terms and Conditions apply to all reservations and stays at Casa del Viento, located on Bonaire. By making a reservation, the renter agrees to these terms and conditions.
2. Reservation and payment
- A reservation is confirmed upon receipt of the deposit.
- The deposit amounts to 50% of the total booking amount. The remaining amount must be paid no later than 60 days before arrival.
- For reservations made within 60 days of arrival, the full amount must be paid immediately upon booking.
- If payments are not made on time, the landlord reserves the right to cancel the reservation.
3. Cancellation
In the event of cancellation more than 60 days before arrival, the deposit will be refunded, less 10% administration costs.
No refund will be granted for cancellations within 60 days prior to arrival.
No refunds will be given in the event of a no-show or early departure.
Any cancellation costs may possibly be covered by travel or cancellation insurance.
4. Non-refundable rate
If a non-refundable rate is selected, the full amount must be paid upon booking.
In that case, changes or cancellations are not possible and no refund will be given.
5. Arrival and departure
- Check-in is possible from 15:00.
- Check-out must take place no later than 10:00 AM.
- Alternative times are only possible in consultation and subject to availability. Additional costs may apply.
6. Use of the villa
- Casa del Viento is a private villa and intended exclusively for recreational use.
- The villa has three bedrooms and is suitable for a maximum of 6 people. It is not permitted to exceed this number without prior permission.
- It is not permitted to organize parties, events, or gatherings in the villa.
- The tenant must take the surroundings into account and prevent noise nuisance.
- Smoking is only permitted outside.
- Pets are not allowed, unless agreed in writing in advance.
- Subletting or allowing third parties to use the villa is not permitted.
7. Warranty
The landlord reserves the right to request a security deposit prior to the stay.
Any damage, loss, extra cleaning costs, or other costs arising from the use of the villa may be deducted from the deposit.
If the costs exceed the deposit, the tenant is obliged to pay the remaining amount.
8. Damage and reporting obligation
- The tenant is responsible for the villa and the inventory present during the stay.
- Any damage or defects must be reported immediately to the landlord.
- Damage occurring during the stay that is not the result of normal use may be recovered from the tenant.
9. Cleaning and maintenance
For stays of multiple days, the villa is cleaned once a week.
The tenant must leave the villa in reasonable and tidy condition upon departure.
Additional cleaning costs resulting from exceptional soiling may be charged.
10. Utilities
The tenant must handle water and electricity with care.
Excessive or unreasonable consumption may be charged.
11. Liability
Staying at Casa del Viento and using all facilities, including the swimming pool and outdoor showers, is entirely at your own risk.
The landlord is not liable for loss, theft, damage, or injury of any kind during the stay, unless caused by intent or gross negligence.
12. Force Majeure
The landlord cannot be held liable for situations of force majeure, such as natural disasters, extreme weather conditions, pandemics, government measures, or other circumstances beyond the landlord's control.
13. Accessibility and location
The exact arrival instructions and access information will be provided prior to the stay.
14. Applicable law
The law of the Caribbean Netherlands (Bonaire) applies to all agreements.
